Going About It The Wrong Way

If terrorists get constitutional rights under this latest Supreme Court decision, and if Obama's advisors say Bin Laden is innocent until proven guilty, why are we trying to kill terrorists? Why aren't we trying to arrest Osama Bin Laden, read him his Miranda rights, and give him a lawyer?
